Welcome to Testament Tab (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website at https://testamenttab.com (the “Site”), purchase of our Bible chapter pull-out tab product (the “Product”), and any related services. The Product is a convenient pull-out tab that displays Bible chapters with page numbers, eliminating the need to flip to the index or use multiple individual tabs. We sell the Product online via the Site and in person. By accessing the Site, creating an account, or making a purchase, you agree to these Terms. If you do not agree, do not use the Site or purchase the Product.

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site or services after changes constitutes acceptance of the revised Terms.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Site or purchase the Product. By using the Site, you represent that you meet these requirements.

2. Account Registration

You may create an account on the Site to manage orders and profile information. When creating an account, you agree to provide accurate, current, and complete information, including your name, email address, and shipping address. We do not store credit card or payment information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use by emailing [email protected]. We reserve the right to suspend or terminate accounts at our discretion.

3. Products and Orders

  • Description: The Product is a pull-out tab for Bibles displaying chapters and page numbers.
  • Availability: Products are subject to availability. We reserve the right to discontinue or modify the Product without notice.
  • Pricing: Prices are in USD and exclude shipping, taxes, and fees unless stated otherwise. We may change prices at any time.
  • Orders: All orders are subject to acceptance and availability. We may refuse or cancel any order. Upon order placement, you will receive a confirmation email, but this does not guarantee fulfillment until shipped.
  • Payment: Payments are processed via third-party providers. We do not store payment details.
  • Shipping: We currently ship only within the United States. Shipping costs are calculated at checkout and are non-refundable except in cases of defect. Delivery times are estimates.

4. Returns, Refunds, and Exchanges

  • Defective Products: We offer returns for defective Products within 30 days of delivery. To initiate a return:
    1. Submit a return request via the Site or email [email protected].
    2. Provide proof of purchase and photos of the defect.
    3. Follow shipping instructions provided. We will refund the Product price (excluding original shipping) upon receipt and inspection. Return shipping is paid by us for defects.
  • Exchanges: Within 30 days of delivery, you may exchange a non-defective Product. You pay return shipping and new shipping costs. Exchanges are subject to availability.
  • Non-Returnable: Used, damaged (non-defective), or personalized items are not eligible for return or exchange.
  • Refunds: Refunds are issued to the original payment method within 14 days of approval. No refunds after 30 days.

5. Affiliate Program (Coming Soon)

We are developing an affiliate link program. Details will be provided separately upon launch. Tentative terms include:

  • Affiliates earn 10% commission on net sales generated via their unique link (Product price minus shipping costs).
  • Example: For a $12 Product with $1 shipping, commission is based on $11, minus any payment processing fees (e.g., 1% ACH transfer fee).
  • Payouts via ACH or other methods chosen by the affiliate, subject to fees.
  • Full affiliate terms will be in a separate agreement. Participation requires approval and compliance with our rules.

6. Intellectual Property

The Site, Product design, content, trademarks, and materials are owned by us or our licensors. You may not reproduce, modify, distribute, or create derivative works without our written permission. Limited personal use is permitted.

7. User Conduct

You agree not to:

  • Use the Site for unlawful purposes.
  • Interfere with Site functionality.
  • Post false, misleading, or harmful content.
  • Attempt to gain unauthorized access.

8. Privacy

We do not store sensitive payment data. Account information (name, email, shipping address) is used for order fulfillment and communication. See our Privacy Policy for details.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT IN QUESTION. THE PRODUCT IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms or use of the Site/Product.

11. Governing Law

These Terms are governed by the laws of the United States and the State of Nevada, without regard to conflict of laws principles. Disputes shall be resolved in courts located in Washoe County, Reno, Nevada.

12. Dispute Resolution

Any disputes shall be resolved through binding arbitration in Washoe County, Reno, Nevada under AAA rules, except for small claims. No class actions.

13. Miscellaneous

  • Severability: If any provision is invalid, the remainder remains in effect.
  • No Waiver: Failure to enforce a right does not waive it.
  • Entire Agreement: These Terms constitute the full agreement.
  • Force Majeure: We are not liable for delays due to events beyond our control.
